Promotion Terms & Conditions:
1. Entry Terms
Upon entering this Promotion/giveaway, you affirm your status as an Eligible Person and acknowledge your agreement to both the Terms and Conditions of Forever Petal and the Terms of Conditions specific to this Promotion, known as the ‘Bridal Giveaway’. Bridal Giveaway Start Date 18/06/2024 2PM AEST , and Bridal Giveaway End Date: 14/07/2024 12AM AEST (referred to as the Promotion Period). Any violation of these terms and conditions, including instances where Forever Petal reasonably suspects a breach, will result in voiding all entries from the individual in question, rendering them ineligible for any Prize.
2. Eligibility Criteria
This Promotion/giveaway is exclusively available to individuals who meet the following criteria:
- Reside in Australia.
- Are 18 years of age or older.
- Meet the entry requirements as per their respective state laws. Please verify with local regulations.
- Have fulfilled all specified requirements for participation in the Promotion (referred to as an Eligible Person).
Only Eligible Persons are eligible to participate in and potentially win any prizes offered in the Promotion.
Participants are responsible for ensuring that their contact details and mailing addresses provided to Forever Petal are up to date at the time of the Promotion.
Employees of Forever Petal, company directors, and their immediate family members (including parents, spouses, de facto partners, siblings, or children) are not eligible to participate or win any prizes offered in the Promotion.
3. How to Enter
To participate in the Promotion/giveaway, an Eligible Person must:
- Purchase one or more of Forever Petal’s ‘digital assets’: Bachelorette Planner, Wedding Guide, Wedding Checklist, Digital Wedding Planner, or one of our digital bundles of these assets during the Promotion Period from https://competition.foreverpetal.com.au
When an individual purchases one or more of our digital assets they receive the number entries displayed depending on which digital asset(s) or bundle they choose to purchase. Additionally, we provide incentive to upsell or upgrade their purchase during the ‘add to cart’ process, at which further entries can be added. For example, a customers chooses to purchase our ‘Bridal Starter Package’, this customer will receive the “Bachelorette Planner’ for $4.99 Exclusive of GST plus 1 entry to the Bridal Giveaway, after the payment details have been confirmed the upsell/upgrade is offered for further digital assets which gives further entries.
Entries are automatically applied to eligible Promotions and are personal, non-transferrable, and not redeemable for cash or any other consideration. No entry fee is required. Entries are only given when one of our digital assets or bundles have been purchased.
Entries must be received before the Promotion Period ends to be eligible. The time of entry is when the registration is received by Forever Petal. Forever Petal is not responsible for late, incomplete, or lost entries.
By entering the Promotion, participants agree that their information may be published as a winner as required by law and these Terms and Conditions.
4. The Prize
The total prize is valued at $2000.00 AUD (inclusive of GST). The value is based on Forever Petal’s Bridal Services that can be found at https://www.foreverpetal.com.au/pages/contact-us at which prices are given during the completion of the bridal enquiry form. This promotion will have only one winner. This prize is redeemable once claimed, for 2 years post the competition ending.
Forever Petal reserves the right to, at its discretion, modify or substitute prizes with reasonable alternative prizes (of equal or greater value than the original prize) if any prize becomes unavailable due to circumstances beyond the control of Forever Petal.
The prizes cannot be transferred, exchanged for cash, or substituted for other goods or services. If, for any reason, the winner is unable, or chooses not to claim any part of the prize, that specific element will be forfeited. Being that Forever Petal hand designs our artwork, quality and consistency may vary, and we take no responsibility for undesired outcomes. Forever Petal takes no responsibility for quality of pressed flowers, due to the organic nature, flowers can be contaminated prior to Forever Petal receiving them. To ensure that Forever Petal can best provide its bridal pressing services, it's advised that the flowers be handed to us within 24 hrs post your wedding day.
5. The Prize Draw
The winner of the The Bridal Giveaway is drawn on the 16/07/2024 12 PM AEST, at Giribil
Family Trust T/A FOREVER PETAL 70 Giribil Track, Bucketty NSW. The draw will be broadcasted live on Instagram and Facebook for public viewing.
Each entry, bearing the name of the Eligible Person, will be printed on a physical piece of paper and placed into a transparent barrel or digital draw. The winning names will then be randomly drawn from this barrel.
The first draw will determine the winner of the Promotion/giveaway. Prior to the draw, the prize to be drawn will be confirmed.
Forever Petal reserves the right to alter the drawing method or streaming process, ensuring randomness and equal chances for all entries. Any changes made will not invalidate the draw.
If the prize remains unclaimed after 90 days from the initial draw date, a redraw will occur via a Barrel Draw at the same location. Winners will be announced on social media.
All winners will receive direct notification within 7 days of the results being determined.
6. How The Prize Is Won
The Winner of the prize will receive notification during the live stream. In the event that a winner does not respond during the live stream, attempts will be made to contact them using the contact details provided to enter the promotion/giveaway.
Results will be available within 7 days of determining the prize winners upon request. Requests for draw results can be submitted in writing to Forever Petal at [email protected].
All winners will be directly notified in writing by email within 7 days of the result's determination. Forever Petal reserves the right to request proof from winners to confirm their eligibility for a prize.
A winner may forfeit a prize under certain circumstances, prompting Forever Petal to randomly select a new winner. These circumstances include failure to claim a prize within 90 days of the draw despite reasonable efforts to contact the winner, breaching the terms and conditions, failure to provide satisfactory evidence of eligibility within 7 days of request, returned correspondence as 'non-deliverable', or inability to deliver the prize within 90 days despite reasonable efforts.
Winners will not incur administrative or delivery fees to receive their prize.
7. Authorisation
Giribil Family Trust T/A Forever Petal is authorised to conduct this trade promotion:
NSW: No permit required as the total prize value for a single trade promotion does not exceed $10,000.
NT: No permit required
ACT: Not required
WA: Terms and Conditions have been sent as per the regulations
VIC: Not required
TAS: Not required
8. Exclusions and Liability
These Terms and Conditions do not limit, exclude, or attempt to limit, exclude, or modify the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia. Forever Petal(including its officers, employees, and agents) disclaims responsibility and excludes liability for personal injury, loss, or damage in the provision of goods or services, or conduct of promotions, arising from various circumstances, including technical difficulties, theft, unauthorised access, late or misdirected entries, network issues, prize variations, transit damage, tax liabilities, prize use, or other circumstances beyond its reasonable control. If events beyond Forever Petal control hinder the Promotion, it may vary, cancel, or reschedule it in accordance with applicable laws and regulations.
9. Term Headings
The headings provided in these Terms & Conditions are purely for convenience and do not alter their interpretation.
10. Entire Agreement
The terms outlined here are the complete agreement between the parties or entrants regarding the participation and management of the Promotion. Each participant confirms they haven't based their participation on any other advertising, promotion, or communication related to the Promotion.
