BY USING THE SITE AND/OR THE SERVICE, OR PURCHASING ONE OR MORE OF OUR PRODUCTS, YOU ACKNOWLEDGE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. THIS SIGNIFIES YOUR AGREEMENT TO BE BOUND BY THEM, INCLUDING ANY MODIFICATIONS MADE BY FOREVER PETAL PERIODICALLY.

Forever Petal reserves the right to modify these terms by posting updates on the Site, and you agree to abide by any such changes. Additionally, Forever Petal retains the right to alter the Site and/or the Service without prior notice, and you acknowledge that your access may be discontinued or restricted at any time, for any reason, with or without notification.

By purchasing our products or services, utilising our platform, or participating in our giveaways, you affirm that you have reviewed and agreed to our Privacy Policy alongside these terms and conditions. Forever Petal reserves the right to update the Privacy Policy, with any revisions being published on the Site. Should you disagree with any aspect of the Privacy Policy at any time, it is imperative to cease using the Site and/or the Service immediately.
2. The Services.
The Forever Petal Site is electronic product and service platform that sometimes offers promotional giveaways in-conjunction with certain products or services.

Forever Petal bears no liability for any damages or losses resulting from the removal of User Content. 4. Reimbursements, product returns, and exchanges
During promotional periods, and or if not downloaded (electronic products), our products are only refundable before the conclusion of the promotion and download. Once the promotion ends, or if the product is electronic and has been downloaded/reproduced, products become non-refundable. If the promotion is ongoing, refunds will be prorated based on the duration of membership held. Our money back Guarantee is not redeemable or refundable after the promotion/giveaway end date.
Our goods and services are subject to guarantees under Australian Consumer Law, which cannot be excluded. In the case of major failures, you have the right to cancel your service contract with us and receive a refund for the unused portion or compensation for its diminished value. Additionally, for major failures with goods, you can choose between a refund or replacement. If a failure does not qualify as major, you're entitled to timely rectification. Refunds or rectifications are not provided for reasons such as change of mind or misunderstanding.
To access certain parts of the Site and Service, registration is required, limited to individuals aged 18 and above. During registration, accurate and complete information, including name, address, and email, must be provided. Failure to do so constitutes a breach of terms and conditions and may result in Account termination. You must keep your Registration Information updated and maintain password confidentiality. By signing up or becoming a customer of Forever Petal, the Participant consents to being added to our marketing list and receiving occasional emails and text messages about our products and services. You always have the option to unsubscribe from marketing emails and texts as per legal requirements.
12. Promotion & Giveaways Disclaimers
By enrolling or becoming a customer of Forever Petal, the Participant agrees to partake in the Contest or Giveaway and accepts the following terms:
- All disputes, claims, and causes of action stemming from the Contest and promotional gifts will be resolved individually without resorting to any form of class action.
- Claims, judgments, and awards will be confined to actual out-of-pocket expenses incurred in entering the Contest, with Forever Petal absolved of any responsibility for legal fees under any circumstances.
- Participants relinquish all rights to claim punitive, incidental, or consequential damages, and any rights to have damages multiplied or increased, apart from actual out-of-pocket expenses incurred in entering the contest.
- Forever Petal, its licensees, parents, affiliates, subsidiaries, related companies, advertising or promotional agencies, officers, directors, employees, representatives, and agents will not be held liable for any damages or losses arising from access to, or use of, the website, electronic or computer malfunctions, or participant involvement in the contest, regardless of whether Forever Petal was informed of the possibility of such damages.
- Forever Petal retains the right to disqualify any Participant found tampering with or abusing any aspect of the Contest, as determined solely by Forever Petal.

When you post any content on social media platforms such as Facebook, Instagram, Twitter, and YouTube about Forever Petal (referred to as the Company) or its products, you grant the Company a perpetual, royalty-free, irrevocable, non-exclusive, and fully sub-licensable right to use, modify, reproduce, publish, adapt, translate, and create derivative works from it. Additionally, you provide the Company and its affiliates with the right to use the name associated with the content. You confirm that you own or have full control over the rights to the content you have posted.
